Privacy Policy

BehavedChart ("we," "us," or "our") is a service of Keller LLC, a Florida limited liability company. We operate the website behavedchart.com and the BehavedChart behavior tracking application (collectively, the "Service"). This Privacy Policy explains how we collect, use, disclose, and protect information when you use our Service.

By using BehavedChart, you agree to the collection and use of information in accordance with this policy. If you do not agree, please discontinue use of the Service.

1 Information We Collect

Account Information

When you create an account, we collect:

• Full name
• School email address
• Account creation date and time

Roster & Operational Data

As you use the Service, we collect and store data you provide, including:

• Roster names, grade/section labels, and class names you create
• Student first and last names and grade assignments
• Behavior definitions (names and descriptions) you configure
• Behavior log entries, including student name, behavior, class, date, and time
• Names and email addresses of teachers and co-teachers you invite to your roster
• Custom branding assets you upload (logos, colors)

Usage & Technical Data

We may automatically collect certain technical information, including:

• Browser type and version
• Device type and operating system
• IP address
• Pages visited within the Service and timestamps

Guest Logger Data

Guest teachers who access the Service via a join code do not create accounts. No personally identifiable information is collected from guest loggers beyond the behavior log entries they submit, which are attributed to the roster — not to the individual guest.

2 How We Use Your Information

We use the information we collect for the following purposes:

• To provide, operate, and maintain the Service
• To authenticate users and manage account security via magic-link email sign-in
• To display behavior reports and roster data to authorized users
• To send transactional emails (sign-in links, invitations) — we do not send marketing email without your consent
• To enforce tier limits and, in the future, manage subscription billing
• To diagnose technical problems and improve the Service
• To comply with applicable legal obligations

3 Student Data & FERPA

BehavedChart is used by schools and educators to log student behavior data. This data may qualify as "education records" under the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. § 1232g.

When schools and educators use BehavedChart, the school or lead teacher (the "Roster Owner") is the data controller for their roster's student records. Keller LLC acts as a service provider processing that data on the Roster Owner's behalf.

• We access student data only as necessary to provide the Service
• We do not share student data with third parties except as required to operate the Service (e.g., our hosting and database providers — see Section 4)
• We do not sell student data or use it for advertising
• Roster Owners are responsible for ensuring they have appropriate authority under their school or district policies to collect and store the student data they input into BehavedChart

4 How We Share Information

We do not sell your personal information or student data. We share information only in the following limited circumstances:

Service Providers

We use third-party providers to operate the Service. These providers process data only on our behalf and under confidentiality obligations:

• Supabase — database hosting, authentication, and backend services. Data is stored in Supabase's cloud infrastructure.
• Bluehost — web hosting provider for behavedchart.com
• Stripe (future) — payment processing for paid subscriptions. Stripe handles payment data directly and we do not store full payment card details.

Within Your Roster

Roster data — including student names, behavior logs, and class information — is visible to all authenticated members of a given roster (lead teachers, co-leads, and co-teachers) as well as guest loggers with a valid join code. You control who has access to your roster.

Legal Requirements

We may disclose information if required to do so by law or in response to valid legal process, including to comply with a court order, subpoena, or other legal obligation.

Business Transfers

If Keller LLC is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you via email or prominent notice on the Service if this occurs.

5 Data Retention

We retain your account and roster data for as long as your account is active or as needed to provide the Service. If you delete your account or request deletion of your data, we will remove your personal information and roster data from our active systems within a reasonable time, subject to any legal retention obligations.

Behavior log entries, student records, and roster data associated with your account are deleted when you delete the relevant roster or close your account. We do not retain backups of deleted user data indefinitely.

6 Security

We take reasonable technical and organizational measures to protect your data. These include:

• Authentication via Supabase Auth with magic-link email sign-in (no passwords stored)
• Row-Level Security (RLS) policies on our database to ensure users can only access their own roster data
• HTTPS encryption for all data transmitted between your browser and our servers
• Access controls limiting which personnel can access production data

However, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security, and you use the Service at your own risk. If you believe your account has been compromised, contact us immediately at behavedchart+legal [at] behavedchart [dot] com.

7 Cookies & Local Storage

BehavedChart uses browser-based storage to operate the Service:

• Authentication cookies/tokens — set by Supabase Auth to maintain your logged-in session. These are essential for the Service to function.
• localStorage — we store your active roster selection locally in your browser so it persists across sessions on the same device. No personal data is stored in localStorage beyond a roster ID.

We do not use third-party advertising cookies or tracking pixels. We do not use Google Analytics or similar tracking services at this time.

You can clear browser cookies and localStorage at any time through your browser settings. Doing so will sign you out of the Service and reset your roster selection.

8 Children's Privacy

BehavedChart is a tool for educators and school staff. We do not knowingly collect personal information directly from children under 13. The Service is not directed at students — it is used by teachers and school staff to log behavioral observations.

Student names and behavioral data entered into the Service are provided by and remain the responsibility of the Roster Owner (the lead teacher or school). Roster Owners are responsible for ensuring they have appropriate consent and authority under applicable law, including FERPA and the Children's Online Privacy Protection Act (COPPA), to input and store student information in the Service.

If you believe we have inadvertently collected personal information directly from a child under 13 without appropriate consent, please contact us at behavedchart+legal [at] behavedchart [dot] com and we will take steps to delete it.

9 Your Rights & Choices

Depending on your location, you may have certain rights regarding your personal information, including:

• Access — request a copy of the personal information we hold about you
• Correction — request that we correct inaccurate or incomplete information
• Deletion — request that we delete your personal information and roster data
• Portability — request your data in a portable format

To exercise any of these rights, contact us at behavedchart+legal [at] behavedchart [dot] com. We will respond to verifiable requests within a reasonable time frame.

Florida residents may have additional rights under the Florida Digital Bill of Rights. We will honor applicable state privacy law requirements as they apply to our Service and scale of operations.

10 Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the effective date at the top of this page. If changes are material, we will provide additional notice — such as a notification within the Service or an email to your account address.

Your continued use of BehavedChart after any changes constitutes your acceptance of the updated Privacy Policy.
