1 Nature of the Service

BehavedChart is a web-based behavior logging and tracking application designed to help teachers and school staff record, organize, and review behavioral observations about students in their care. It is a productivity and organizational tool — nothing more.

The Service is intended to support educators in their day-to-day work by providing a convenient, organized way to note behavioral patterns over time. It is not designed or intended to serve as a substitute for any formal educational, psychological, medical, or legal process.

All behavioral data entered into BehavedChart reflects the subjective observations of the educator who logged it. BehavedChart does not validate, verify, or independently assess any data entered by users.

2 Not a Clinical or Diagnostic Tool

BehavedChart is not a clinical assessment tool, psychological evaluation instrument, or diagnostic system. Nothing in the Service — including behavior names, descriptions, logs, patterns, or reports — constitutes a clinical diagnosis, psychological evaluation, or medical opinion of any kind.

Behavioral observations logged in BehavedChart should not be used to:

• Diagnose or suggest a diagnosis of any behavioral, developmental, psychological, or medical condition
• Replace or substitute for a formal evaluation by a licensed psychologist, counselor, therapist, or other qualified professional
• Inform individualized education program (IEP) determinations as the sole or primary source of behavioral data without appropriate professional oversight
• Serve as the basis for recommending medication, therapy, or other clinical interventions

If you have concerns about a student's behavior, development, or wellbeing, please consult with qualified school support professionals, including counselors, psychologists, or special education staff, in accordance with your school or district's procedures.

3 Not an Official Records System

BehavedChart is not an official student records system and is not intended to replace any official school documentation, disciplinary records, student information systems, or other records maintained by your school or district.

Data logged in BehavedChart should not be treated as or used in place of:

• Official student disciplinary records
• Special education evaluation documentation
• Legally required records under FERPA or any other applicable law
• Any records required by your school, district, or state education agency

BehavedChart data may be used as a personal professional reference or informal observational log to supplement your work — but you should follow your school or district's official policies for any formal documentation requirements.

4 Not Legal Advice or Documentation

Nothing on the BehavedChart website or within the Service constitutes legal advice. Keller LLC is not a law firm and does not provide legal services.

Behavioral data logged in BehavedChart is not intended to serve as legal documentation and should not be submitted as evidence in legal proceedings, administrative hearings, or other formal proceedings without appropriate review by qualified legal counsel.

If you are involved in a situation that may have legal implications — including but not limited to student discipline appeals, special education disputes, abuse reporting, or litigation — please consult a qualified attorney and follow your school or district's official protocols.

5 Accuracy of Logged Data

BehavedChart stores and displays data exactly as entered by users. We do not independently verify, review, or validate any behavioral data entered into the Service. The accuracy, completeness, and appropriateness of all logged data is entirely the responsibility of the user who entered it.

Keller LLC is not responsible for any decisions made — or consequences arising — from behavioral data that is inaccurate, incomplete, misinterpreted, or used in a manner inconsistent with this Disclaimer or our Terms of Service.

Educators are encouraged to use BehavedChart as one tool among many and to apply their professional judgment when interpreting behavioral patterns and reports.

6 No Guarantee of Availability

We strive to keep BehavedChart available and reliable, but we do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, technical issues, third-party service outages, or circumstances beyond our control.

We strongly recommend that educators do not rely solely on BehavedChart as their only record of behavioral observations, particularly for situations that may require documentation. We are not liable for any loss of data or consequences arising from service interruptions or data loss.

7 Third-Party Services

BehavedChart relies on third-party services — including Supabase for database and authentication services and Bluehost for web hosting — to operate. We are not responsible for the actions, policies, or availability of these third-party providers.
